CDT Europe’s Feedback on the Draft Guidelines for the Classification of High-Risk AI Systems under the AI Act
CDT Europe responded to the European Commission’s consultation on the draft guidelines for the classification of high-risk artificial intelligence systems. The guidelines aim to clarify when an AI system would be considered to pose a high-risk under the AI Act. Given that the majority of the AI Act’s requirements apply to providers and deployers of high-risk AI systems, this classification is the primary gateway through which to ensure that affected individuals are protected from the consequential harms AI systems can pose.
In our response, we focus on ensuring that the scope of different high-risk use cases is understood in a broad manner to include a wide range of harmful AI systems, highlighting unwarranted exclusions and the need for a consistent, global reading of the AI Act. We welcome the guidelines’ comprehensive reading of an AI system’s intended use. Building on this approach, we ask for further clarifications, especially regarding general-purpose AI systems.
